Platts reported that three of Spain''s second tier steel companies plan to challenge in court a new Ministerial Order about auctions of interruptible power capacity, as it does not go far enough to increase competition.

Grupo Gallardo Balboa, Sidenor and Siderurgica Sevillana said they would appeal to the country''s highest constitutional court, the Tribunal Supremo, a new mechanism that "is uncompetitive and tailored for the benefit of a few".
Under EU pressure regarding the Clean Energy for All Europeans package, Spain last year altered the conditions by which interruptible contracts were awarded, with a temporary system put in place for January to May this year, and a new scheme proposed to run from June.
However, the new proposal to reduce the size of the largest blocks on offer to 50 MW from 90 MW for the next sale will make no difference to the outcome, as the same winners of the 90 MW blocks will continue to benefit from the new system, the companies said.
That was because the new auction proposals specify that the interruptible capacity must be available for at least 91% of the time each month a criterion that the companies say "practically no other company can meet".
"The new auction will make it more difficult for the steel companies to obtain the block required to remain competitive in the national, European and international markets. As such, they are intending to not take part."
The process, drafted by the energy ministry (Minetad), was open to feedback until April 20, with the new auction expected to be held in mid-May.
Meanwhile, the regulator, Comision Nacional de los Mercados y la Competencia said that the new proposal was too costly, too complex and did not meet EU norms.
