Economic Times reported that the National Green Tribunal had summarily given the decision-making power to the committee on the question of whether or not the factory should be allowed to function again. The Supreme Court has directed the National Green Tribunal to decide on the question of maintainability and merit of Vedanta-owned Sterlite Copper''s plea challenging closure order of its factory by Tamil Nadu, disposing of at the same time a petition filed by the state seeking a stay on proceedings at Tribunal. In essence, the committee set up by the NGT in an order on August 20 to decide on reopening the factory can progress unhindered.
Earlier the Tribunal had replaced retired Punjab and Haryana High Court judge SJ Vazifdar with former Meghalaya high court judge Tarun Agarwala as the head of the three-member committee to decide on the reopening of the factory. The National Green Tribunal had summarily given the decision-making power to the committee on the question of whether or not the factory should be allowed to function again. It had disposed of the petition filed by Sterlite Copper too, adding that parties aggrieved with the decision of the independent Committee ~ it will comprise officials from the Ministry of Environment and Forests and the Central Pollution Control Board - can approach the Tribunal again.
